Welcome to Vivian Ivy. These Terms of Service govern your use of our website, online store, in-store services, local pickup, local delivery, shipping, custom orders, and related services. By visiting our website, placing an order, or purchasing from us, you agree to these Terms.

1. About Vivian Ivy Chocolatiers

Vivian Ivy Chocolatiers is a specialty chocolate shop offering curated chocolates, confections, gifts, custom orders, corporate gifts, wedding favors, gift baskets, and related products. Our products may be sourced from multiple chocolatiers, makers, and vendors. Product availability, ingredients, packaging, and pricing may change without notice.

2. Online Store Use

You agree to use our website and online store only for lawful purposes. You may not misuse the site, attempt to interfere with its operation, submit false information, or use the site in a way that harms Vivian Ivy, our customers, our service providers, or anyone else. Very rude. The robots are watching.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to our website or services at our discretion.

3. Product Information

We do our best to display product names, descriptions, images, pricing, ingredients, sizes, and availability accurately. However, errors may occur. Product photos are for general representation only. Actual packaging, assortment, shape, color, decoration, or presentation may vary.

Chocolate is a handmade or artisan product in many cases, and natural variation is expected. Seasonal items, limited releases, and imported or vendor-supplied products may become unavailable without notice.

If an item you ordered is unavailable, we may contact you about a substitution, refund, or order adjustment.

4. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices may change at any time without notice. Taxes, shipping fees, delivery fees, and other charges may be added at checkout.

Payment is due at the time of purchase unless otherwise agreed in writing for corporate, wedding, or custom orders. We may cancel or delay orders if payment is declined, incomplete, suspected to be fraudulent, or otherwise cannot be processed.

5. Order Acceptance and Cancellation

Placing an order does not guarantee acceptance. We reserve the right to accept, decline, modify, or cancel any order for reasons including product availability, payment issues, suspected fraud, pricing errors, weather concerns, shipping restrictions, or operational limitations.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method when applicable.

Customers may request cancellation before an order is prepared, shipped, delivered, or made custom. Once an order is in progress, fulfilled, shipped, delivered, or specially prepared, cancellation may not be possible.

6. Local Pickup

Local pickup orders must be collected during our posted business hours. Please wait for confirmation that your order is ready before coming to the store.

Chocolate is temperature-sensitive. Once an order is picked up, responsibility for proper storage and handling transfers to the customer. We recommend keeping chocolate cool, dry, and away from direct sunlight, heat, humidity, strong odors, and pets who think they are people.

7. Local Delivery

Local delivery may be available within designated areas and during available delivery windows. Delivery availability, fees, timing, and minimum order requirements may vary.

Customers are responsible for providing accurate delivery information. If no one is available to receive the order, or if the order is left at a doorstep, lobby, mailroom, reception area, or other location at the customer’s request or due to delivery circumstances, Vivian Ivy is not responsible for melting, theft, damage, delay, or loss after delivery.

8. Shipping

We may ship eligible products within the continental United States, subject to availability and weather conditions. We do not guarantee shipping to every location or for every product.

Chocolate is delicate and heat-sensitive. We may use insulated packaging, ice packs, expedited shipping, or limited shipping windows when appropriate. During warm weather or extreme conditions, shipping may be delayed, restricted, upgraded, or unavailable.

Shipping times are estimates and are not guaranteed unless expressly stated. Carrier delays, weather events, incorrect addresses, missed deliveries, holidays, and other circumstances outside our control may affect delivery.

Once an order is transferred to the shipping carrier, risk of delay or mishandling by the carrier may pass to the customer, except where prohibited by law. We will do our best to help resolve issues, because apparently civilization requires forms and tracking numbers.

9. Warm Weather and Perishable Products

Chocolate and confections may melt, bloom, soften, shift, or become damaged if exposed to heat, sunlight, humidity, or improper storage. We are not responsible for damage caused by:

  • Packages left outside, in mailrooms, on porches, or in warm vehicles
  • Incorrect or incomplete shipping addresses
  • Delivery delays caused by the carrier
  • Missed delivery attempts
  • Customer-selected shipping methods that are not suitable for weather conditions
  • Failure to retrieve or refrigerate products promptly after delivery

If you are shipping chocolate as a gift, please make sure the recipient will be available to receive it.

10. Allergens and Dietary Information

Our products may contain or come into contact with common allergens, including but not limited to milk, eggs, wheat, soy, peanuts, tree nuts, sesame, coconut, alcohol, and other ingredients. Products may be made in facilities or handled in environments where allergens are present.

We cannot guarantee that any product is free from allergens or cross-contact unless expressly stated in writing by us. Customers with allergies, dietary restrictions, medical conditions, or ingredient concerns are responsible for reviewing product information and contacting us before purchase.

Do not consume any product if you are unsure whether it is safe for you.

11. Alcohol-Containing Products

Some chocolates or confections may contain alcohol or alcohol-based flavorings. Customers are responsible for reviewing product descriptions and making appropriate purchasing decisions. Products containing alcohol may not be suitable for children, pregnant individuals, people avoiding alcohol, or those with certain dietary or religious restrictions.

12. Custom Orders, Weddings, Corporate Gifts, and Gift Baskets

Custom orders, wedding favors, corporate gifts, gift baskets, special designs, large orders, and event orders may require advance notice, deposit, full payment, consultation, design approval, or written confirmation.

Custom orders are subject to availability of products, packaging, labor, and timeline. Because custom orders are prepared specifically for the customer, they may be non-refundable once approved, ordered, assembled, or prepared.

Changes to custom orders must be requested as early as possible. We may not be able to accommodate changes after preparation has begun.

13. Substitutions

For assorted boxes, gift baskets, custom gifts, and seasonal collections, individual flavors or items may vary based on availability. We reserve the right to make substitutions of equal or greater value when necessary, while preserving the general style and quality of the order.

14. Returns, Refunds, and Exchanges

Because chocolate and confections are food products, we generally cannot accept returns or exchanges once products have left our store, been delivered, or been shipped.

If there is an issue with your order, please contact us promptly at [email address] with your order number, photos if applicable, and a description of the concern. We may, at our discretion, offer a replacement, store credit, refund, or other resolution.

Refunds are not guaranteed and may not be available for issues caused by improper storage, heat exposure after delivery or pickup, incorrect address information, carrier delays, missed delivery attempts, personal taste preferences, or failure to read product descriptions or allergen information.

15. Gift Cards and Promotions

Gift cards, discount codes, coupons, and promotional offers are subject to their stated terms. They may have restrictions, expiration rules where permitted by law, minimum purchase requirements, product exclusions, or usage limits.

Promotions cannot be applied retroactively unless we choose to do so. We reserve the right to modify, suspend, or cancel promotions at any time.

Gift cards are not redeemable for cash except where required by law.

16. Account Information and Communications

If you create an account or place an order, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

By placing an order or contacting us, you agree that we may communicate with you about your purchase, order status, delivery, pickup, customer service, and related matters. Marketing communications may be subject to separate consent and unsubscribe options.

17. Intellectual Property

All website content, including text, photos, graphics, branding, logos, designs, product descriptions, layout, and other materials, is owned by Vivian Ivy or used with permission, unless otherwise stated. You may not copy, reproduce, distribute, modify, or use our content without prior written permission.

Vendor names, product names, and third-party trademarks belong to their respective owners.

18. User Content

If you submit reviews, photos, comments, testimonials, social media tags, or other content to us or about us, you grant Vivian Ivy permission to use, repost, display, and share that content for marketing, promotional, and business purposes, unless you tell us otherwise in writing.

You are responsible for ensuring that your submitted content is accurate, lawful, and does not violate the rights of others.

19. Third-Party Services

Our website and services may rely on third-party providers for payment processing, shipping, delivery, analytics, marketing, reviews, maps, email, SMS, and other functions. We are not responsible for the acts, omissions, policies, or services of third parties.

To the fullest extent permitted by law, Vivian Ivy and its owners, employees, contractors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of our website, products, or services.

Our total liability for any claim related to an order will not exceed the amount paid for that order, except where prohibited by law.

You agree to indemnify and hold harmless Vivian Ivy, its owners, employees, contractors, vendors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of our website or services, violation of these Terms, violation of law, or infringement of the rights of another person or entity.

24. Force Majeure

We are not responsible for delays, failures, or losses caused by events outside our reasonable control, including severe weather, carrier delays, supply shortages, labor disruptions, power outages, natural disasters, public health emergencies, government actions, technical failures, or other unexpected events. Basically, if reality decides to throw a pie at the machinery, we reserve the right to clean up first.

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles, unless another jurisdiction is required by applicable law.

Any disputes will be handled in the state or federal courts located in Michigan, unless otherwise required by law.

We may update these Terms at any time. Changes will be posted on this page with a revised “Last updated” date. Continued use of our website or services after changes are posted means you accept the updated Terms.
